Abstract
This first Country Procurement Assessment Report (CPAR) on Moldova comes at a time when the country has publicly committed itself to the signal departure of acceding to the WTO Agreement o n Government Procurement (GPA). It will be the first developing country in Eastern Europe t o do so. The CPAR's key findings, including risk assessment, the strengths and weaknesses of the public procurement system currently in place, and the main features of a proposed action plan are summarized here. Public procurement represents a substantial element of the expenditure side of the Government's budget. Estimates prepared for this assessment indicate that total expenditure on procurement amounted to approximately US$118 million. Procurement accounted for 17 percent of total expenditures by the State government and 42 percent of expenditure by local governments, with expenditure at all levels showing substantial increases over past years. Improving the efficiency of that expenditure can contribute to better budget management. Yet control of public procurement expenditures in Moldova is weak and the overall procurement environment is high- risk. While the procurement law provides a reasonably sound basis for public procurement, and will need to be amended to align it with the WTO Agreement on Government Procurement. I t is further undermined by the absence of implementing regulations. Procurement practices are often inconsistent with the procurement law, Primary among these is the heavy overuse of the Single Source Procurement method, whereby the procuring entity contracts directly with a single supplier, with n o competition. Weaknesses in the law permit other bad practices. Resources: While the NAGP is seen as providing a valued service to procuring entities and is progressively extending its coverage, its reach is limited at the local government level. However, the Agency is not being held accountable for its performance of its regulatory and oversight functions and, because it is one of the bodies which makes the Government's decisions on procurement, it cannot act independently when reviewing bid protests. Procuring entities lack the capacity to conduct procurement effectively and in accordance with the procurement law, and there is political interference in procurement decision making. The report recommends that The current procurement law should be amended, and the Government should enact a comprehensive set of implementing regulations to underpin the law. The position of Executive Director of the NAGP should be filled immediately. The NAGP should be held more accountable for the performance of its functions. New institutional arrangements should be made for the independent review of bid protests It is necessary to build public sector capacity to undertake public procurement As a short-term action, given the urgent need to train the dedicated procurement staff of the 35 recently establish territorial administrative units, the NAGP should conduct training courses in public procurement for those units by the end of 2003.

    Uzbekistan : Country Procurement Assessment Report

    Uzbekistan inherited the Soviet system for the procurement of goods, works and services for State needs. This system was suitable for a command economy but lacks the essential elements of competitiveness, transparency and accountability, which are the hallmarks of a market-based approach to government contracting. This Country Procurement Assessment Report (CPAR) comes at a time when a number of factors are creating an increased need for public procurement reform. Primary among these is that Uzbekistan has concluded a Partnership and Cooperation Agreement (PCA) with the European Union which commits the Government to develop conditions for open and competitive award of procurement contracts. Also, the country's application for membership to the World Trade Organization (WTO) may lead to accession to the WTO Agreement on Government Procurement (GPA), thereby creating an obligation on Uzbekistan to align its procurement legislation with the GPA. The report, examines all areas of public procurement operations, including, legislative framework, performance of regulatory functions, capacity of public sector institutions and the effects of corruption on procurement. It also recommends the Government to prepare a new draft Law on Public Procurement based on the January 2000 draft Law on Government Procurement.

    Bosnia and Herzegovina - Country Procurement Assessment Report : Social Protection

    This first Country Procurement Assessment Report (CPAR) for Bosnia and Herzegovina (BiH), looks at public procurement operations, in consultation with counterparts from the ministeries of Finance, of the Federation of BiH, of the Republic of Srpska, and of the cantons of Sarajevo, Travnik, Mostar, and Banja Luka. It focuses on the following key themes: ensuring reduced, and more efficient public spending; increasing transparency, by improving access to information on bidding opportunities, and public contract spending; improving the ability of public institutions on appropriate spending of public procurement funds, and institutional regulation of procurement; fighting the risks of corruption; and promoting access to the World Trade Organization, and European Union. Key findings suggest that procurement is a neglected function, where the absence of a State law on procurement is a serious omission, assessing the public procurement environment is high-risk. There are many weaknesses in the current legal system, though current frameworks are reasonably aligned, and governments are willing to harmonize them further. Nonetheless, gaps in the legislation breed abusive practices in public procurement, fostered by poor enforcement, though the benefits of competitive bidding are becoming known, and some large purchasers are using standard bidding documents for all procurement. Recommendations include the need for procurement laws at the State, and entity levels, supported by implementing regulations, while organizational reform is needed to improve enforcement.

    Turkey : Country Procurement Assessment Report

    Public procurement legislation in Turkey has not kept pace with the sweeping reforms undertaken in the national procurement systems of many other countries during the same period nor with the development of internationally recognized bodies of procurement legislation, such as those of United Nations Commission on International Trade Law (UNCITRAL), the European Union (EU) and the World Trade Organization (WTO). Following Turkey's acceptance, in December 1999, as a candidate country for accession to the EU, the Government has committed itself to achieving approximation and, eventually, alignment with EU law in many areas, including public procurement. To that end, the MOF and MPWS have already begun the process of drafting a new public procurement law, a draft of which has already been promulgated within Government and on which both the World Bank and the European Commission have offered their comments. Clearly, it is essential that this new draft law should not only make up the ground lost in the 17 years since the GPL was last amended but also bring the Turkish law up to date with recognized models of best practice and achieve an appropriate degree of approximation with the EU Directives. However, it is unlikely that approximation, let alone full alignment, can be achieved with a single reform of the law. Rather, it is recommended that the Government should aim to develop a new public procurement law which meets the standards of transparency, accountability and competitiveness set by the UNCITRAL Model Law but which also balances the need to prepare a path towards increasing harmonization with the EU Procurement Directives. This report also recommends that: 1) The Government should make it a top priority to draft a new national public procurement law and submit it to the Turkish Grand National Assembly by October 2001. This new law should meet the standards of transparency, accountability and competitiveness enshrined in the UNCITRAL Model Law. The new draft law should be developed with appropriate input from Turkey's key development partners, primarily the World Bank and the European Union, and should be discussed and agreed with them. The new law should also be underpinned by detailed implementing regulations, to be developed and issued shortly after the enactment of the new law. 2) The scope of the law should cover all public procurement for which budgetary resources (such as the general and annexed budgets) and extra-budgetary resources are used, including the non-commercialized stat economic enterprises. 3) In drafting and enacting the new public procurement law, the Government should ensure an adequate level of consultation with both the public and private sectors. To achieve this, an inter-ministerial Drafting Committee should be entrusted with responsibility for drafting the new public procurement law and should be supported by specialist international procurement law experts. 4) To complement these measures, the Government should put in train a planned and progressive program of legislative reform in order to move Turkey's public procurement legislation, over the medium term, to alignment with the EU Procurement Directives by the time Turkey accedes to the European Union.

    Vietnam - Country Procurement Assessment Report : Transforming Public Procurement

    The transition from a centrally planned economy to a "socialist oriented market economy" in Vietnam has called for comprehensive changes in the legal framework of the State. The last ten years have witnessed great progress in the development of the Vietnamese legal system, both in substantive and procedural matters. A number of important legal instruments have been promulgated, such as the Constitution in 1992; the Land Law in 1993; and the Civil Code in 1996. More recent normative instruments include the Commercial Law of 1997 and various Ordinances and Regulations on matters such as foreign investment, management of investment and construction, national bidding procedures, conduct of public employees, control of corruption and thrift in the use of public funds. Procurement in the public sector in Vietnam was governed mainly by Decrees issued by the Government. The key existing legal instruments governing public procurement are summarized in Table 1. In addition, there are other Decrees and Inter-Ministerial circulars, which contain provisions concerning public procurement and use of public funds. The report discusses key issues such as the legal and regulatory framework; procurement procedures and practices; institutional framework; human resources and procurement capacity; state-owned enterprises and gives recommendations.     Former Yugoslav Republic of Macedonia : Country Procurement Assessment Report

    The emergency nature of many of the measures taken to meet the challenges which Macedonia has faced in recent years, including the Kosovo crisis and the recent threat to the country's security, has contributed to a general laxity in the enforcement of the country's laws, including the LPP. Compliance with the procurement law has been further undermined by the absence of the institutional machinery necessary to support implementation, particularly an authoritative body to oversee enforcement and provide institutions operating under the law with guidance on its application. Whilst the Ministry of Finance (MOF) is formally charged with authority over public procurement, it is only recently that MOF has dedicated resources to perform key oversight functions. That said, the MOF unit charged with this onerous obligation, the Public Procurement Division of the Ministry's Legal Department, lacks the stature and capacity to discharge its functions effectively. Furthermore, the institutions which should play an indispensable role in performing oversight of public procurement, including the State Auditor's Office, have not yet been operating effectively. Weak enforcement is further exacerbated by a low level of awareness of the law's provisions, the roots of which lie partly in inadequate dissemination, and by the absence of sufficient numbers of public officials trained in procurement, a shortcoming which is particularly acute in self-governing units of local government. Most public officials who carry out procurement are inexperienced and lack the procurement-specific training necessary to apply the law accurately. There is also a severe problem of excessive political interference in contract award decisions in Macedonia. This is not only invited by the absence of an effective oversight institution but is, in fact, formalized by the common practice, enshrined in the LPP, of assigning to high-ranking political officials, in particular Ministers, the authority to award procurement contracts. The assessment also found evidence of many bad practices which are routinely applied to procurement in Macedonia. Principal among these is that, instead of providing bidders with formal, written bidding documents, public purchasers often only advertise an invitation to bid in a local newspaper as the sole means for soliciting bids. Such advertisements regularly include the cost estimate for the contract being tendered, the publication of which may facilitate collusion and price-fixing among bidders. Other practices which obstruct transparency include failing to disclose bid evaluation criteria to bidders in advance, the widespread use of subjective methods of evaluating bids and over-use of an "accelerated procedure" provision in the LPP, by which the period allowed to bidders to prepare their bids may be reduced from 36 days to 15 days or less. This is clearly open to manipulation by purchasers who want to give an unfair advantage to a favored bidder. Several more examples of bad practices identified by the assessment are provided in Section 2 of this report, with detailed recommendations to address them presented in Section 2.3. In order to address these weaknesses, this report recommends a number of short- term measures, designed to plug the most pressing gaps in Macedonia's national public procurement system, combined with longer-term recommendations aimed at more wide-reaching reform and development of the legal and institutional framework for procurement.

    The Argentina Country Climate and Development Report (CCDR) explores opportunities and identifies trade-offs for aligning Argentina’s growth and poverty reduction policies with its commitments on, and its ability to withstand, climate change. It assesses how the country can: reduce its vulnerability to climate shocks through targeted public and private investments and adequation of social protection. The report also shows how Argentina can seize the benefits of a global decarbonization path to sustain a more robust economic growth through further development of Argentina’s potential for renewable energy, energy efficiency actions, the lithium value chain, as well as climate-smart agriculture (and land use) options. Given Argentina’s context, this CCDR focuses on win-win policies and investments, which have large co-benefits or can contribute to raising the country’s growth while helping to adapt the economy, also considering how human capital actions can accompany a just transition.

    The economy continues to contract, albeit at a somewhat slower pace. Public finances improved in 2021, but only because spending collapsed faster than revenue generation. Testament to the continued atrophy of Lebanon’s economy, the Lebanese Pound continues to depreciate sharply. The sharp deterioration in the currency continues to drive surging inflation, in triple digits since July 2020, impacting the poor and vulnerable the most. An unprecedented institutional vacuum will likely further delay any agreement on crisis resolution and much needed reforms; this includes prior actions as part of the April 2022 International Monetary Fund (IMF) staff-level agreement (SLA). Divergent views among key stakeholders on how to distribute the financial losses remains the main bottleneck for reaching an agreement on a comprehensive reform agenda. Lebanon needs to urgently adopt a domestic, equitable, and comprehensive solution that is predicated on: (i) addressing upfront the balance sheet impairments, (ii) restoring liquidity, and (iii) adhering to sound global practices of bail-in solutions based on a hierarchy of creditors (starting with banks’ shareholders) that protects small depositors.

    This year’s Word Development Report (WDR), the twenty-eighth, looks at the role of equity in the development process. It defines equity in terms of two basic principles. The first is equal opportunities: that a person’s chances in life should be determined by his or her talents and efforts, rather than by pre-determined circumstances such as race, gender, social or family background. The second principle is the avoidance of extreme deprivation in outcomes, particularly in health, education and consumption levels. This principle thus includes the objective of poverty reduction. The report’s main message is that, in the long run, the pursuit of equity and the pursuit of economic prosperity are complementary. In addition to detailed chapters exploring these and related issues, the Report contains selected data from the World Development Indicators 2005‹an appendix of economic and social data for over 200 countries. This Report offers practical insights for policymakers, executives, scholars, and all those with an interest in economic development.

    The Journey Ahead: Supporting Successful Migration in Europe and Central Asia provides an in-depth analysis of international migration in Europe and Central Asia (ECA) and the implications for policy making. By identifying challenges and opportunities associated with migration in the region, it aims to inform a more nuanced, evidencebased debate on the costs and benefits of cross-border mobility. Using data-driven insights and new analysis, the report shows that migration has been an engine of prosperity and has helped address some of ECA’s demographic and socioeconomic disparities. Yet, migration’s full economic potential remains untapped. The report identifies multiple barriers keeping migration from achieving its full potential. Crucially, it argues that policies in both origin and destination countries can help maximize the development impacts of migration and effectively manage the economic, social, and political costs. Drawing from a wide range of literature, country experiences, and novel analysis, The Journey Ahead presents actionable policy options to enhance the benefits of migration for destination and origin countries and migrants themselves. Some measures can be taken unilaterally by countries, whereas others require close bilateral or regional coordination. The recommendations are tailored to different types of migration— forced displacement as well as high-skilled and low-skilled economic migration—and from the perspectives of both sending and receiving countries. This report serves as a comprehensive resource for governments, development partners, and other stakeholders throughout Europe and Central Asia, where the richness and diversity of migration experiences provide valuable insights for policy makers in other regions of the world.

    Classroom Assessment to Support Foundational Literacy

    This document focuses primarily on how classroom assessment activities can measure students’ literacy skills as they progress along a learning trajectory towards reading fluently and with comprehension by the end of primary school grades. The document addresses considerations regarding the design and implementation of early grade reading classroom assessment, provides examples of assessment activities from a variety of countries and contexts, and discusses the importance of incorporating classroom assessment practices into teacher training and professional development opportunities for teachers. The structure of the document is as follows. The first section presents definitions and addresses basic questions on classroom assessment. Section 2 covers the intersection between assessment and early grade reading by discussing how learning assessment can measure early grade reading skills following the reading learning trajectory. Section 3 compares some of the most common early grade literacy assessment tools with respect to the early grade reading skills and developmental phases. Section 4 of the document addresses teacher training considerations in developing, scoring, and using early grade reading assessment. Additional issues in assessing reading skills in the classroom and using assessment results to improve teaching and learning are reviewed in section 5. Throughout the document, country cases are presented to demonstrate how assessment activities can be implemented in the classroom in different contexts.
