Abstract
Financial sector authorities increasingly prioritize financial inclusion and financial consumer protection, alongside existing priorities of stability and integrity. An enabling environment that facilitates competition, promotes innovation and the use of technology, addresses risks in a proportionate manner, and empowers financial consumers to make informed choices is critical to improving financial inclusion and consumer protection. The 2017 Global Financial Inclusion and Consumer Protection (FICP) Survey tracks the prevalence of key policy, legal, regulatory, and supervisory approaches to advancing financial inclusion and consumer protection. The 2017 Global FICP Survey covers key topics related to the enabling environment for financial inclusion and financial consumer protection, including national financial inclusion strategies, the issuance of e-money by nonbanks, agent-based delivery models, simplified customer due diligence, institutional arrangements for financial consumer protection, disclosure, dispute resolution, and financial capability. The 2017 Global FICP Survey covers regulated retail institutions that provide standard loan, deposit, or payment services. Financial sector authorities in 124 jurisdictions – representing 141 economies and more than 90 percent of the world’s unbanked adult population – responded to the 2017 Global FICP Survey. This report presents main findings from an analysis of those responses.

Publication Financial Inclusion and Consumer Protection in Peru(World Bank, Washington, DC, 2010-02)As part of its Global Policy Initiative, Consultative Group to Assist the Poor (CGAP) partnered with the Superintendence of Banks, Insurance and AFPs of Peru in late 2008, with the purpose of enhancing the understanding of the issues and trends in consumer relations when financial services are delivered through branchless banking, particularly through agents, which are used in ever increasing scale in Peru. The product was this joint report. Three other countries with relevant experience in branchless banking (Kenya, Brazil and India) participated in a similar exercise at approximately the same time. As in the case of Peru, the exercise gave an opportunity for regulators of each jurisdiction to look at their regulatory and institutional framework for protecting branchless banking users, evaluate their regulatory and supervisory actions, and identify areas for improvements. A forthcoming CGAP focus note complements the effort, by making an overall evaluation of the lessons learned in these countries and drawing on the knowledge from other pioneer countries such as South Africa, Mexico, Colombia and the Philippines. The focus note will point out and address priority areas of concern and possible regulatory and policy options to address them. The first part of the report outlines the financial inclusion efforts currently being undertaken by the Superintendence. The following section summarizes the most important points of the legal and regulatory framework for financial consumer protection, pointing out any specificity of branchless banking. The third part describes the branchless banking business in Peru and describes the issues and problems identified in the relationship between branchless banking clients and providers, and the supervisory and enforcement implications. The last section draws conclusions and makes recommendations for achieving a balance between openness to innovation and protection in a branchless banking environment.Publication Action Plan for Strengthening Financial Services Consumer Protection in Azerbaijan(World Bank, Washington, DC, 2009-12)This Action Plan is based on the World Bank’s Technical Note on Consumer Protection and Financial Literacy in Azerbaijan published in June 2009. The Action Plan focuses on the Legal and Regulatory Issues of the Technical Note’s Key Findings and Recommendations, proposing specific actions for Azerbaijani authorities, financial institutions and consumer organizations so that consumer protection is strengthened and made more effective and efficient. The Action Plan should be the base upon which specific legal changes should be drafted and against which their implementation should be evaluated. Beside the Technical Note itself, the Action Plan draws on best international practices and experiences of regulators and supervisors that have tried to introduce improved consumer protection in their countries. It should also be noted that a well-balanced consumer protection regime serves also the interest of financial institutions as it provides them with better informed clients and also makes sure that clients understand their obligations under the contracts they signed. The Action Plan is divided into five parts that cover the key areas based on the recommendations of the Technical Note: (a) Legal Mandate, (b) Effective Supervision and Regulation, (c) Disclosure of Information, (d) Business Practices, and (e) Dispute Resolution.Publication Global Survey on Consumer Protection and Financial Literacy Results Brief : Regulatory Practices in 114 Economies(Washington, DC, 2013)Financial consumer protection and financial education policies, in conjunction with the regulation of financial institutions and markets, need to ensure safe access to financial services and support financial stability and financial inclusion objectives. Consumer protection and financial literacy can contribute to improved efficiency, transparency, competition, and access to retail financial markets by reducing information asymmetries and power imbalances among providers and users of financial services. Rapid progress toward widespread financial inclusion must be appropriately complemented with checks and balances that ensure a responsible provision of financial services and products. A number of international efforts are in place to improve dialogue and identify best practices in financial consumer protection. To contribute to the international dialogue on financial consumer protection the World Bank in conjunction with Fin-CoNet, an international cooperation platform for supervisory agencies in the area of financial consumer protection, conducted a global survey on consumer protection and financial literacy to collect information from financial regulatory agencies in 114 economies. This brief summarizes the key results of the survey and accompanies the release of the data collected to provide timely feedback on the results.Publication Country Studies Provide Powerful Lessons in Financial Consumer Protection(World Bank, Washington, DC, 2010-07)Until the financial crisis of 2007, the global economy was adding an estimated 150 million new consumers of financial services each year. Rates of increase have since slowed but the growth continues. Most new consumers are in developing countries where consumer protection and financial literacy are still in their infancy. This is particularly true in countries that have moved from central planning to market economies where protecting consumers is necessary to ensure stable and competitive financial markets and give new consumers confidence in the formal financial systems. The global financial crisis has highlighted the importance of consumer protection and financial literacy for the stability of the financial sector. In the US, the rapid growth of complex residential mortgage products, combined with securitized instruments which were sold to poorly informed parties, has caused much turmoil. Financial institutions worldwide have been obliged to write off trillions of dollars of assets. In Europe and Central Asia (ECA) too, damage to the financial sector was serious.Publication Latvia : Action Plan on Financial Consumer Protection(Washington, DC, 2010-04)This paper forms the action plan for financial consumer protection, and focuses on the main findings and recommendations. These include proposing specific actions to be undertaken by Latvian authorities, financial institutions and consumer organizations, so that consumer protection is strengthened and made more effective and efficient. Existing industry ombudsmen should publish cases they have dealt with, as well as their yearly activity report, which should be provided to the Financial and Capital Market Commission (FCMC), and to the Consumer Rights Protection Center (CRPC). The action plan draws on best international practices and experiences of regulators and supervisors, who have tried to introduce improved consumer protection regimes in their countries. A well balanced consumer protection regime serves the interest of financial institutions as it provides them with better-informed clients and makes sure that clients understand their obligations under the contracts they signed. The paper takes into account the current macroeconomic situation in Latvia, and focuses primarily on measures that demand little to no financing requirements. When actions with a funding need are recommended, the action plan provides an estimate of necessary costs. The plan recommends that the guidance should focus on ensuring independence of decisions made by the ombudsman, low costs for the public, and the binding nature of ombudsman's decisions for financial institutions.

Publication Unlocking Local Finance For Sustainable Infrastructure(Washington, DC: World Bank, 2024-09-20)This study aims to further address gaps in research related to commercial financing challenges in Local Currency Financing (LCF) for sustainable infrastructure. This will include a review of broader financial market challenges with a focus on credit/banking markets. This study is part of a broader program supported by the Public-Private Infrastructure Advisory Facility (PPIAF) to address the challenges in mobilizing LFC commercial lending into infrastructure and climate projects, public-private partnerships (PPPs), and risk sharing facilities in emerging markets. The study has drawn on the work done by the World Bank Group in particular the Infrastructure Finance Practice Group (IFP); Finance, Competitiveness & Innovation Global Practice (FCI); and the related donor-funded Joint Capital Markets Program (J-CAP) implemented by the Finance Competitiveness and Innovation Global Practice (FCI) and IFC. Through this report we expect that policy makers, money and capital market authorities, infrastructure, climate and environment, and private sector infrastructure/climate investors and financial institutions will be better informed to pursue financing options for infrastructure projects through LCF. Specifically, the report provides global knowledge and existing literature on the topic of LCF with a focus on local credit markets, an analytical framework, and actionable insights to navigate the complexities of LCF in infrastructure and climate investments. The study explains the key drivers and enablers/binding constraints for the development of a robust ecosystem for financing infrastructure in local currency (LCY), such as: (i) the scale of private savings in a country; (ii) the ability and willingness of local credit markets to provide long-tenor debt; (iii) the potential for local capital markets to provide finance; (iv) the cost differential between LCY and foreign currency (FX) debt; and (v) capacity for structuring and credit evaluation skills for sustainable infrastructure financing.Publication Digital Africa(Washington, DC: World Bank, 2023-03-13)All African countries need better and more jobs for their growing populations. "Digital Africa: Technological Transformation for Jobs" shows that broader use of productivity-enhancing, digital technologies by enterprises and households is imperative to generate such jobs, including for lower-skilled people. At the same time, it can support not only countries’ short-term objective of postpandemic economic recovery but also their vision of economic transformation with more inclusive growth. These outcomes are not automatic, however. Mobile internet availability has increased throughout the continent in recent years, but Africa’s uptake gap is the highest in the world. Areas with at least 3G mobile internet service now cover 84 percent of Africa’s population, but only 22 percent uses such services. And the average African business lags in the use of smartphones and computers as well as more sophisticated digital technologies that catalyze further productivity gains. Two issues explain the usage gap: affordability of these new technologies and willingness to use them. For the 40 percent of Africans below the extreme poverty line, mobile data plans alone would cost one-third of their incomes—in addition to the price of access devices, apps, and electricity. Data plans for small- and medium-size businesses are also more expensive than in other regions. Moreover, shortcomings in the quality of internet services—and in the supply of attractive, skills-appropriate apps that promote entrepreneurship and raise earnings—dampen people’s willingness to use them. For those countries already using these technologies, the development payoffs are significant. New empirical studies for this report add to the rapidly growing evidence that mobile internet availability directly raises enterprise productivity, increases jobs, and reduces poverty throughout Africa. To realize these and other benefits more widely, Africa’s countries must implement complementary and mutually reinforcing policies to strengthen both consumers’ ability to pay and willingness to use digital technologies. These interventions must prioritize productive use to generate large numbers of inclusive jobs in a region poised to benefit from a massive, youthful workforce—one projected to become the world’s largest by the end of this century.Publication Innovative Experiences in Access to Finance(Washington, DC: World Bank, 2017-07-05)Interest in access to finance and awareness of its importance have increased significantly since the early 2000s. Growing evidence suggests that lack of access to credit prevents many households and firms from financing high-return investment projects, which has an adverse effect on growth and poverty alleviation. Despite the increasing awareness of the importance of access to finance among both researchers and policymakers, there are still some major gaps in our understanding of the main drivers of access, as well as about the impact of different policies in this area. This book aims to fill some of these gaps by discussing recent innovative experiences in broadening access to credit in Latin America. These experiences are consistent with an emerging new view that, while recognizing the central role of the public sector in improving the contractual and informational environment for financial markets, also contends that there might be room for well-designed, restricted interventions in collaboration with the private sector to foster the development of financial markets and broaden access to them. In particular, the book analyzes, among other things, some interesting experiences from Brazil, Chile, Colombia, and Mexico that use different instruments to broaden access to credit in a sustainable way, such as structured finance, factoring, credit guarantees, and correspondent banking. Most of these experiences have led to financial innovation by developing new financial products and coordinating different players in the financial and real sectors to overcome barriers to access to credit. The book provides a first systematic analysis of these innovative experiences, including an analytical framework to understand problems of access to finance and a discussion of the effects and optimal design of public interventions. Finally, the book discusses some open policy questions about the role of the private and public sectors (including state‐owned banks) in broadening access to finance in a sustainable and market-friendly manner.Publication Good Practices for Financial Consumer Protection, 2017 Edition(World Bank, Washington, DC, 2017-12-12)Over the past decade, financial consumer protection has become an increasingly mainstream priority for policymakers. A strong consumer protection regime is key to ensuring that expanded access to financial services benefits consumers, enabling them to make well-informed decisions on how best to use financial services, building trust in the formal financial sector, and contributing to healthy and competitive financial markets. The World Bank’s Good Practices for Financial Consumer Protection (the Good Practices) was developed in 2012 as a contribution to the emerging global set of tools on financial consumer protection. Since then, international guidance and country practices regarding financial consumer protection have substantially evolved. The 2017 Good Practices is designed to serve as a comprehensive reference and assessment tool for policymakers that consolidates the latest research, international guidance, and country examples. A thorough update of the previous edition, this guide expands upon priority areas such as supervisory techniques, effective disclosure, and digital finance, and also emphasizes the practical considerations and tradeoffs that policymakers face when implementing new policies and practices.Publication World Development Report 2023: Migrants, Refugees, and Societies(Washington, DC : World Bank, 2023-04-25)Migration is a development challenge. About 184 million people—2.3 percent of the world’s population—live outside of their country of nationality. Almost half of them are in low- and middle-income countries. But what lies ahead? As the world struggles to cope with global economic imbalances, diverging demographic trends, and climate change, migration will become a necessity in the decades to come for countries at all levels of income. If managed well, migration can be a force for prosperity and can help achieve the United Nations’ Sustainable Development Goals. World Development Report 2023 proposes an innovative approach to maximize the development impacts of cross-border movements on both destination and origin countries and on migrants and refugees themselves. The framework it offers, drawn from labor economics and international law, rests on a “Match and Motive Matrix” that focuses on two factors: how closely migrants’ skills and attributes match the needs of destination countries and what motives underlie their movements. This approach enables policy makers to distinguish between different types of movements and to design migration policies for each. International cooperation will be critical to the effective management of migration.
