dc.description.abstract | The recent growth in investor-state arbitration has continued apace. International Center for Settlement of Investment Dispute (ICSID) registered a record 38 cases in 2011, and had registered 19 further cases by June 30, 2012. Included in these numbers are 3 new conciliation cases, showing an increased resort not simply to arbitration but also to alternative methods of dispute resolution available under the ICSID convention and additional facility. Such statistics should not be considered in isolation from their broader economic context. There have been unprecedented increases in global flows of foreign direct investment in the last two decades. These statistics must also be read in light of the fact that international investment law and investor-state dispute settlement are a new discipline. ICSID continues to play a vital role in the evolving international investment legal system. Its primary job is very specific: to offer foreign investors and host States an impartial, effective and accessible facility for arbitration and conciliation of international investment disputes. ICSID has taken numerous steps in the past year to enhance its capacity to fulfill this role. In September of 2011, ICSID announced a new list of Chairman's appointees to the panel of arbitrators and panel of conciliators. El arbitraje entre inversionistas y Estados ha continuado creciendo a un ritmo acelerado. El CIADI registró un récord de 38 casos durante el 2011, y al 30 de junio de 2012 registró 19 casos más. Dentro de estos números se encuentran incluidos tres nuevos casos de conciliación, lo que evidencia un incremento no solo en el recurso al arbitraje, sino también a métodos alternativos de resolución de conflictos. dc.description.abstract | Ce rapport annuel du Centre international pour le règlement des différends relatifs aux investissements internationaux (CIRDI) couvre l’exercice allant du 1er juillet 2011 au 30 juin 2012. La mission première du CIRDI est très précise : offrir aux investisseurs étrangers et aux États hôtes des moyens d’arbitrage et de conciliation impartiaux, efficaces et accessibles pour régler des différends relatifs à des investissements internationaux. La croissance qu’a récemment connue l’arbitrage entre investisseurs et États s’est poursuivie à un rythme soutenu. En 2011, le CIRDI a enregistré un record de 38 affaires et, au 30 juin 2012, il a déjà enregistré 19 affaires, dont 3 nouvelles affaires de conciliation, ce qui démontre un recours accru non seulement à l’arbitrage mais également aux modes alternatifs de règlement des conflits disponibles sous la Convention CIRDI et le Mécanisme supplémentaire. Au cours de l’année dernière, le CIRDI a administré plus de 100 audiences dans plusieurs villes à travers le monde, et de nombreuses décisions et sentences ont été rendues par des tribunaux et des comités ad hoc. Environ 45 % de l’ensemble des instances jamais enregistrées par le CIRDI sont actuellement en cours, et l’on peut donc prédire avec certitude que cette tendance va se poursuivre au cours de l’année prochaine.
