Its intended audience includes academics, judges, lawyers, and policymakers. Its focus is on businesses rather than natural persons. The authors hope to give the reader a sense of some of the principal approaches to managing the general default of a business debtor. The authors will discuss the nature of the costs and benefits arising from the various policy choices legislators have made. In the process, they will emphasize the close interrelationship among various elements of an insolvency regime so that these elements can be viewed as part of an overall system and not just as a series of policy decisions about particular rules, such as the method of initiation of an insolvency case or the balance struck in setting the boundaries of an avoidance power. The organization of the book reflects our view of insolvency laws as complete systems, including not only the 'insolvency' or 'bankruptcy' code of a jurisdiction but also closely related laws and the institutional framework in which those laws are applied. The book takes a systematic approach to a variety of topics related to credit and insolvency regulation. The functional analysis starts with the study of debt enforcement, continues with an examination of general corporate insolvency legislation, corporate rehabilitation proceedings, informal workouts, employee rights, judicial and administrative institutions, and the considerations key to cross-border insolvency proceedings.en-USCC BY-NC-ND 3.0 IGOaccountantAccurate Informationadministration of insolvencyadministrative debtAdministrative Institutionsadministrative procedureadministrative receiverAssetsAssignment of ContractsBankruptcyBankruptcy Lawbankruptcy policybankruptcy proceedingbusiness debtorBusiness InsolvencyBusiness LawCash FlowCertified Public AccountantsChoice of Lawcivil lawclaimClaimantscollateralcollection procedurecollusive biddingCommencement of Insolvencycommencement of insolvency proceedingscommercial debtorscommercial lawComparative Lawconcealment of assetscontractual relationshipsCorporate GovernanceCorporate InsolvencyCorporate Insolvency LawCorporate Insolvency Legislationcorporate lawCorporate reorganizationscourt actioncourt judgmentscourt ordercredit costscredit systemCredit Systemscreditorcreditor interestscreditor rightsCreditor Rights SystemsCreditorscriminal lawDebtdebt collectiondebt collection lawsdebt-collectionDebtordebtor's propertyDebtorsdebtsdefault judgmentdefaultsDerivativesDispositionDissenting CreditorsEffective Insolvencyenforcement mechanismEnforcement of Judgmentsenforcement of securityequality of distributionEstateExempt Propertyfinancial crisisfinancial distressFinancial InstitutionsFinancial Responsibilityfinancial systemsflow of creditforeign judgmentsForeign ProceedingsFraudfree marketGeneral Counselgeneral observationgoing concerngoing concern valuegoing-concerngoing-concern valuegrace periodindividual creditorindividual debtInformal WorkoutInformal Workoutsinsolvency administratorInsolvency Administratorsinsolvency caseInsolvency CasesInsolvency Codeinsolvency courtinsolvency fieldInsolvency Lawinsolvency law reformInsolvency Lawsinsolvency mattersinsolvency practitionerInsolvency Procedureinsolvency proceduresInsolvency Proceedinginsolvency proceedingsinsolvency processinsolvency regimeinsolvency regimesinsolvency regulationinsolvency remedyinsolvency systemInsolvency Systemsinstitutional frameworkInsuranceInsurance Companiesintellectual propertyinternational bankruptcyinternational businessInternational Financial Lawinternational insolvencyinternational insolvency lawjudgementjudgesjudgmentjudicial systemJudiciaryJurisdictionjurisdictionslegal proceedinglegal systemlegal systemsLegislative Guide on Insolvency Lawlegislative reformslenderlendersleveragelienlien on propertyLiensLiquidationliquidation caseliquidation proceedingliquidation valueloanModel LawModel Law on Cross-Border Insolvencymortgagemovable propertymunicipal insolvencyNegotiationnegotiationsnonpaymentnonpayment of debtnotice of insolvencyOfficer Liabilityoperation of lawout-of-court workoutsPersonal LiabilityPersonal PropertyPersonal Property SecuritiesPersonal Property SecurityPossessionPreferential TransferPreferential TransfersPrivate Lawpro-creditorpro-debtorprocedural lawproperty rightprotection of creditorprovision of creditpublic registryReceivershipreform of insolvency lawRehabilitation ProceedingsRemediesreorganizationreorganization procedurerepossessionRestructuring Planrights of creditorsrights of debtorssale of propertysale of the collateralsecure paymentseizure of propertyspecific assetspecific assetsStatutory ProvisionsTitletransaction lawtransaction lawstransactions Lawtransactions lawsTransnational Insolvency ProjecttrusteesUniform Commercial Codeunsecured creditunsecured creditorunsecured creditorsUnsecured Debtvalid claimWagesA Global View of Business Insolvency SystemsWorld Bank10.1596/978-0-8213-8103-8
